Privacy
Information about personal data processed when you visit this website or contact Cyberkern.
Controller and scope
The controller is Edin Abazovic, Cyberkern, Klara-Straße 57, 45130 Essen, Germany. You can contact me about privacy matters at kontakt@cyber-kern.com.
This notice covers the website and contact enquiries. Processing within a separately agreed security engagement is addressed independently before that engagement begins.
Accessing and delivering the website
The website is delivered through Cloudflare Workers and static files. The provider is Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA. A visit involves processing the IP address, requested address including any submitted URL parameters, time, request method, browser and connection information, and the referring page where available. These data support delivery, stability and security. The legal basis is Article 6(1)(f) GDPR; the legitimate interest is reliable and secure operation of this website.
When you open the root address without a language path, the language sent by your browser is used to select a suitable version. Manually selected language paths remain unchanged. The website application does not store a language preference in cookies or browser storage. It has no visitor database and does not routinely log form contents. This is distinct from Cloudflare’s operational and security processing.
Local functions and audience measurement
Cyberkern has not embedded advertising trackers, externally loaded fonts or social networks. Optional website statistics and the cookie that remembers your choice are described in the next section. The website application uses neither Local Storage nor Session Storage. The contact form’s security check is described separately.
Search, filters and preparation of an enquiry outline run in your browser. Using them alone does not send their inputs to Cyberkern. A download that you initiate is saved on your device. Form details are transmitted only when you submit the contact form.
Optional website statistics with Cloudflare
With your voluntary consent, we use Cloudflare Web Analytics, provided by Cloudflare, Inc., to assess and improve this website’s use and technical performance. This includes page views, referring pages, and browser and performance information such as loading times. Form contents and local search inputs are not recorded as analytics events. Cloudflare uses no analytics cookies or fingerprinting for this service. According to Cloudflare, the IP address received when establishing the connection is discarded at the processing data centre and is not stored in its central analytics databases or logs. Service information: https://developers.cloudflare.com/speed/observatory/rum-beacon/.
Analytics loads only after you explicitly agree. Access to device information and the personal data processing initiated by Cyberkern rely on section 25(1) of the German TDDDG and Article 6(1)(a) GDPR. Declining does not affect use of the website or contact form. Your statistics choice is independent of the contact form’s security check. You can change your choice and withdraw consent for future processing at any time through ‘Analytics settings’. Withdrawal does not affect the lawfulness of earlier processing or recall data already transmitted. The information about possible Cloudflare processing outside the EEA also applies to these statistics.
To respect your decision, the website stores the necessary preference cookie cyberkern_stats after you choose, for up to 180 days (Max-Age 15552000 seconds). It contains only v1.accepted or v1.denied: the version and your acceptance or refusal, without a visitor identifier. The cookie uses Secure and SameSite=Lax and is used solely for this choice. This necessary storage relies on section 25(2), point 2 of the German TDDDG. You can change your choice through ‘Analytics settings’ or delete the cookie in your browser. After expiry or deletion, statistics remain disabled until you agree again.
Contact form and email
The form requires your name, email address and message. Company information is optional, and you may leave the service undecided. The form language, service selection and security check result are also processed. The form does not accept attachments. It cannot submit without the required information and a successful security check; you can contact me by email instead. There is no legal obligation to use the form.
Form data travel over an encrypted connection to the website processing at Cloudflare. Following successful checks, the enquiry is sent over encrypted SMTP through IONOS to the Cyberkern mailbox. Your email address is used as the reply address. No automatic email is sent to you. The confirmation on the website confirms acceptance of the message for sending.
The public address kontakt@cyber-kern.com forwards to the IONOS business mailbox used by Edin Abazovic. Email is provided by IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, Germany. Direct emails involve processing sender and recipient details, subject, timestamps, contents and any attachments you send. Edin Abazovic handles enquiries; no CRM or additional regular mailbox user is involved. Mail rules only sort incoming messages by contact route within the mailbox.
Purposes and legal bases for handling enquiries
The information is used to understand and answer your enquiry and discuss possible services. Article 6(1)(b) GDPR applies when this concerns a contract with you personally or pre-contractual steps requested by you. For company contacts and other business enquiries, the basis is Article 6(1)(f) GDPR; the legitimate interest is appropriate business communication. Any specific legal retention duty is based on Article 6(1)(c) GDPR.
Contact details are not used for newsletters or advertising without a separate basis. The website does not make decisions about you based solely on automated processing that produce legal or similarly significant effects.
Cloudflare Turnstile protection for the contact form
Cloudflare Turnstile loads only after you explicitly enable the security check in the form. Cloudflare processes information including IP address, browser information and connection characteristics such as the TLS fingerprint. The service protects the form against unwanted automated messages; Cloudflare also uses signals to improve its bot detection as a controller and states legitimate interests as its own legal basis. A verification token is checked on the server before sending. Further information: https://www.cloudflare.com/turnstile-privacy-policy/
Loading Turnstile, the resulting access to device information and the disclosure of personal data initiated by Cyberkern require your voluntary consent under section 25(1) of the German TDDDG and Article 6(1)(a) GDPR. Before activation, the form explains the purposes and possible processing in the United States. Without this consent, Turnstile does not load and the form cannot send. You can email kontakt@cyber-kern.com instead. Handling your enquiry itself relies on the contact-related legal bases explained above.
Consent is held only for the current page. You can withdraw it for further checks by reloading the page. A new explicit activation is then required. Reloading does not recall signals already transmitted; withdrawal does not affect the lawfulness of earlier processing. Turnstile pre-clearance is disabled, so this feature does not request an additional cf_clearance cookie.
Separate Cloudflare security checks may use technically necessary security cookies on suspicious requests to recognise completed checks. Their purpose is to prevent attacks on the website service you requested. Where that access is strictly necessary for this purpose, the basis is section 25(2), point 2 of the German TDDDG; processing personal data for security is based on Article 6(1)(f) GDPR. Cookie details: https://developers.cloudflare.com/fundamentals/reference/policies-compliances/cloudflare-cookies/.
Recipients and processing outside the EEA
Cloudflare processes website and form data to provide the infrastructure; IONOS processes email data to operate the mailbox. Their subprocessors are governed by the respective data processing terms. Other recipients may include competent authorities where a specific legal disclosure duty applies.
When you consent to website statistics, Cloudflare additionally receives the usage and performance data described in that section to provide Cloudflare Web Analytics.
Cloudflare may process data outside the European Economic Area, particularly in the United States. Its contractual terms provide for EU Standard Contractual Clauses and the EU-US Data Privacy Framework for applicable transfers. You can request a copy or further information about the relevant safeguards at kontakt@cyber-kern.com. Contract details: https://www.cloudflare.com/cloudflare-customer-dpa/
Cloudflare acts as controller for certain network and security data used for its own purposes. Its notice is available at https://www.cloudflare.com/privacypolicy/. Processing of all website data exclusively in Germany or Europe is not promised.
Retention and deletion
Enquiries are reviewed monthly for continued retention needs. Completed enquiries that do not lead to an engagement are deleted from the active mailbox no later than six months after the last substantive message. The trash is emptied within a further 30 days. This is a manual process; the website does not automatically delete mailbox messages.
Exceptions apply to data still needed for a specific legal retention duty or an ongoing dispute. Use is then restricted to that purpose, and the data are deleted when the reason ceases to apply. If an engagement results, further retention follows its contractual purpose and the statutory duties applicable to the individual records.
The website holds form details in working memory only while processing the sending attempt and has no separate database for them. Successful delivery produces an email in the mailbox, subject to the periods above. Technical data and backups at the infrastructure and email providers follow their purpose-related retention and deletion procedures; deleting a mailbox message does not necessarily remove backup copies immediately.
According to Cloudflare, we can access Web Analytics statistics for the previous six months in its dashboard. This availability does not guarantee deletion of all data processed by the provider after exactly six months. Cloudflare describes seven days of unsampled beacon data, followed by a reduced sample for longer-term reporting. The preference cookie’s 180-day period applies only to remembering your choice in the browser, not to retention of statistics. Further information: https://developers.cloudflare.com/web-analytics/faq/.
Confidential information
Please do not send access credentials or particularly sensitive information through the form or an unencrypted email. The website and SMTP delivery use transport encryption; this does not provide end-to-end email encryption. A suitable transfer method for confidential documents is agreed separately.
Your rights
Subject to the relevant legal conditions, you have rights of access, rectification, erasure, restriction of processing and data portability under Articles 15 to 20 GDPR. Where processing relies on your consent, you may withdraw it for the future without affecting the lawfulness of earlier processing. To exercise your rights, contact kontakt@cyber-kern.com.
Right to object
Where processing is based on Article 6(1)(f) GDPR, you may object under Article 21 GDPR on grounds relating to your particular situation. Processing will then stop unless compelling legitimate grounds overriding your interests, rights and freedoms are demonstrated, or the processing serves the establishment, exercise or defence of legal claims.
Complaints to a supervisory authority
Under Article 77 GDPR, you may complain to a data protection supervisory authority, particularly in the country of your habitual residence, place of work or the alleged infringement. For North Rhine-Westphalia: Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, Postfach 20 04 44, 40102 Düsseldorf, Germany; email: poststelle@ldi.nrw.de; contact and complaints: https://www.ldi.nrw.de/kontakt.
